Release and Waiver of Liability

  1. Student represents that (s)he is in good physical condition, is not suffering from any heart, lung or other bodily ailment and is in all respects physically fit to engage in the martial arts course.
  2. Student is hereby been advised that strict observance of the rules and regulations relative to self-defense training is mandated. There is always the possibility of accident, injury or death, and all Naga employees and representatives will take all precautions possible to prevent and reduce the risk of, such.
  3. Physical contact will be used by employees of Naga, other students and authorized individuals, as part of the course of instruction. Student has been advised of such fact and gives full consent to any physical contact as may be required or customary to martial arts training.
  4. In recognition of the possibility of accident, injury or death connected with martial arts training, student waives any right or cause of action of any kind arising as the result of such activity from which any liability may or could accrue to Naga its officers, agents, employees, instructors and/or students.
  5. We, the student & guarantor, if applicable, on behalf of ourselves, members of our family, our heirs, executors, administrators and assigns, hereby forever release, discharge and hold harmless, Naga representatives and agents for any injury, loss, or damage to my/our person or property howsoever caused, arising out of or in connection with my taking part in martial arts classes and activities and notwithstanding that the same may have been contributed to or occasioned by the negligence of Naga Representatives or agents.
  6. For Summer Camps I understand that there are no refunds.
  7. By entering into this agreement the undersigned grants Naga permission to use photographs, videotapes, artwork or other likenesses of the student for marketing, trade, publishing or any other lawful purpose.

By checking the box, I agree to act responsibly with the techniques that will be taught at Naga. Under no circumstances shall the information learned at Naga be used outside Naga unless required for self-defense. I pledge to uphold the traditions and honor of the martial arts and the rules and regulations of Naga. I have read all the terms set forth on this agreement and acknowledge full responsibility to the terms and conditions stated herein as required for participation.

Payment Agreement and Terms

The undersigned promises to pay a monthly recurring fee as shown in this transaction. Each subsequent installment will occur on the same day of each consecutive month. This is a month-to-month agreement cancelable with 30 days’ written/emailed notice.

I Authorize Naga to make this deduction from my credit card monthly as stated in the payment information above.

Agreement and Conditions

  1. Failure to attend class does not signify nor imply notification to cancel this agreement.
  2. Cancelation of this agreement is in your hands.
  3. The undersigned assumes all responsibility for any costs of collection, including but not limited to reasonable collection agency fees, court costs, reasonable attorney’s fees and applicable late charges that may be incurred for default payments.
  4. Naga administrators may make modifications in the class schedule as deemed necessary. Such modification does not relieve the undersigned of their payment obligations under any circumstances.
  5. The tuition costs for Naga’s martial arts program are based on a 4-week month, or a 48-week year. Naga administrators may close the school for the purposes of special events and for a period not exceeding four weeks per year for necessary maintenance and other purposes without affecting scheduled tuition payments. Naga closes in observation of Memorial Day, The Fourth of July, Labor Day, and Thanksgiving Weekend. We will also be closed the week between Christmas and New Year, the last week of summer vacation (the week prior to Labor Day) and Spring Break.
  6. By entering into this agreement the undersigned grants Naga permission to use photographs, videotapes, artwork or other likenesses of the student for marketing, trade, publishing or any other lawful purpose.
  7. In consideration of the martial arts training obtained, the student agrees not to engage in martial arts teaching practices within a 25 mile radius of Naga or any other school associated with the Naga’s administrators, for a period of 3 years following disassociation with the Naga without written permission.
  8. Payment of tuition fees does not guarantee belt certification by Naga administrators.
  9. Membership is cancelable but is non-transferable to another student or family member.
  10. Undersigned authorizes the use of disclosed email address for billing purposes and acknowledges that email text may include financial information pertaining to the membership.

  2. Student has been advised that strict observance of the rules and regulations relative to martial arts self-defense training is mandated and includes the use of protective equipment. Naga does not warrant that the protective equipment will completely eliminate the possibility of accident, injury or death, but may reduce the risk of accident, injury or death.
  3. Physical contact will be used by employees of Naga, other students and authorized individuals, as part of the course of instruction. Student has been advised of such fact and gives full consent to any physical contact as may be required or customary to martial arts training.
  4. In recognition of the possibility of accident, injury or death connected with martial arts training, student waives any right or cause of action of any kind arising as the result of such activity from which any liability may or could accrue to Naga its officers, agents, employees, instructors and/or students.

We, the student & guarantor, if applicable, on behalf of ourselves, members of our family, our heirs, executors, administrators and assigns, hereby forever release, discharge and hold harmless, Naga representatives and agents for any injury, loss, or damage to my/our person or property howsoever caused, arising out of or in connection with my taking part in martial arts classes and activities and notwithstanding that the same may have been contributed to or occasioned by the negligence of Naga Representatives or agents. Please Note: participants must supply their own protective equipment.

 Cancellation Policy

  1. This agreement may be cancelled for any reason without penalty or further obligation within 3 days from the date of this agreement. Cancellation shall be made in writing and issued to Naga by dated mail, or by email. All money paid by you shall be refunded by Naga within 30 days of receipt of this notice of cancellation. However, Naga may retain expenses incurred, and the portion of the total price representing the services used and completed, based on the hourly rate of $35. Down payments are non-refundable after the 3 days.
  2. Agreements are non-cancellable unless stated herein:

Ongoing Agreements:  You may cancel your agreement at any time. The student retains membership rights and privileges until thirty days from your final payment.

Paid in Full Agreements: There are no refunds for early cancellation on advanced payment plans; the remaining balance is transferrable up until 90 days from the cancellation date. After that point, the remaining balance is forfeited.

Special Rates: There are no refunds for early cancellation on special rates; the remaining balance is transferrable up until 90 days from the cancellation date. After that point the remaining balance is forfeited. After the Membership is complete, the student will have the option to roll over to normal student pricing.

Naga reserves the right to refuse membership or to cancel a membership at any time.
